General Terms and contion of Sales

INTRODUCTION
These General Terms and Conditions for Online and Distance Sales are applicable to purchases of Items made remotely:
 
1. by phone, email, chat, instant messaging etc.
 
2.   by Arthur Deruelle, Website identified by the domain name « www.arthurderuelle.com » (hereinafter the « Website »), or by email.
 
Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information.
 
By purchasing an Item, you will be indicating your acceptance of the General Terms and Conditions for Online and Distance Sales and the Privacy Policy in force. During each purchase of Items on the Website, the Customer must indicate his\her acceptance of the General Terms and Conditions for Online and Distance Sales by clicking on the button « Pay and place an order ». 
 
Arthur Deruelle may at any time update and modify the General Terms and Conditions for Online and Distance Sales and Customers will be informed of any such changes in advance of the conclusion of a sales contract. The conditions applicable to the sale of an Item to a Customer are those in effect at the time of the conclusion of the sales contract.
 
 
PLACING ORDERS
The Customer declares that he/she is at least 18 years of age and has the legal capacity or parental authorization to place an order on the Site.
 
All orders are subject to availability. Orders can be placed by Phone or on the Website:
 
1. By Phone:
Orders may be placed by contacting our Client Services at +33 (0)7 81 10 29 42, Monday to Friday from 9:30 am to 18:00 pm, (except public holidays). The language used for orders placed by Phone is French.
 
The Order shall be shipped only after verification of the payment method, receipt of the authorisation to debit the Customer's payment mean, verification of the conformity of the Order with these General Terms and Conditions for Online and Distance Sales.
 
2. By our Website:
Orders can be placed by on the website, by WhatsApp at +33 (0)7 81 10 29 42 or by email at contact@arthurderuelle.com
The languages available for orders placed by the Website are English and French.
 
The Customer must provide the information required for the completion of the Order, including the following information:
 
-    first and last name
-    selection of a payment method and payment details
-    e-mail address and phone number
-    country or region for shipment
-    delivery method
-    billing address
-    delivery address
 
Arthur Deruelle will communicate to the Customer the total price of the Order, as well as any delivery charges where applicable.
 
By proceeding to payment, the Customer accepts these General Terms and Conditions for Online and Distance Sales and enters into a contract for an Order for the Item(s).
 
Once the steps above have been followed, Arthur Deruelle  will send to the Customer, by email, a confirmation of the receipt of the payment of the Order. 
 
Such confirmation of receipt of the payment of the Order constitutes the acceptance of the Customer's Order.
 
 
PAYMENT
Payment for the Customer's purchases can be made by credit card. Cards from the « CB » network, Visa©, MasterCard©, American Express© are accepted. We also accept payment by Paypal, bank transfer and cash.
 
After validation of the bank details by the Customer on the Website, the latter accesses a secure server.
 
The transaction is then carried out by the Customer according to banking security standards. Authentication is specific to each bank. By communicating their bank card number and/or bank details to Arthur Deruelle, on the Website, the Customer accepts in advance and unconditionally that Arthur Deruelle proceeds with the secure transaction and authorize their bank in advance to debit his\her account in view of the records or statements transmitted by Arthur Deruelle, even in the absence of invoices signed by the hand of the holder of the bank card used.
 
When Ordering, the Customer confirms that he/she is the holder of the payment method used to pay for the Order and that the first and last name appearing on this payment method are indeed his/her own.
 
An original ID and /or a bank account certificate may be requested in advance of or after  any payment, including for verification purposes. Receipts will be issued in the name of the Customer who made the payment.
 
1. In case of a payment by bank transfer:
We will send you Arthur Deruelle bank details by email.
 
2. In case of a payment by cash:
We will send you Arthur Deruelle address details by email.
 
 
DELIVERY OF THE ORDER
Once payment of the amount of the Order has been validated, the Items will be delivered to the delivery address. Please take care to ensure the accuracy of the delivery address at the time of ordering, Arthur Deruelle will not be held responsible for sending the packages to an address deemed wrong or an error made during the online registration of your order.
 
If, at the time of delivery, the packaging is damaged, please open the package in the presence of the carrier in order to verify the condition of the products. Where there is damage to the products, you should note the details on the delivery note and contact our Client Services.
 
 
AVAILABIlITY
If the Item(s) ordered are no longer available, Arthur Deruelle will inform the Customer as soon as possible, and either the relevant part of the order will be cancelled, or the Customer may cancel the full order. The deposit paid for the cancelled Item(s) will be immediately refunded to the Customer in full on the payment method used for the transaction. Refunds by bank transfer can take up to 14 days to be processed after the cancellation of the order.
 
 
PRICE OF THE ITEMS
The prices communicated by phone or displayed on the Website are indicated in Euros (€) and are inclusive of all French taxes but exclude any delivery charges which may apply and will be displayed separately before an Order is placed.
 
It is always possible that, despite taking all reasonable care, some of the products we sell may be incorrectly priced. If the product's correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order at the correct price. If we accept and process your order where a pricing error is material, obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any products provided to you.
 
 
OWNERSHIPOF THE ITEMS
Arthur Deruelle will own the items until they are paid for by the customer.
 
 
RIGHTTO CANCEL
As a consumer, you have the legal right to cancel any order within fourteen (14) days of your receipt of the Item without giving any reason. The cancellation period ends fourteen (14) days after the day you or the intended recipient (not the delivery carrier) receives the last Item of the Order.
 
To exercise the right to cancel, you must inform us of your decision to cancel this contract by an unequivocal statement (e.g. a letter sent by post or e-mail), or by using the model cancellation form set, within the fourteen (14) days period set out above.
 
In any case (refund or exchange), the Customer must return the Items as delivered. Items that are returned incomplete, damaged, cleaned, disassembled or altered (no matter how small), cannot be exchanged, or returned.
 
 
REFUND
We will make any refunds due to you as soon as possible. If you are exercising your right to change your mind, your refund will be made within 14 days of your telling us you have changed your mind. We may withhold refund until you show us evidence you have dispatched the products.
 
The expenses of return are the responsibility of the customer and will only be credited or refunded if they are the direct result of an error by Arthur Deruelle.
 
 
AUTHENTICITY ANDGUARANTEE
The items presented for sale by Arthur Deruelle are historical authentic period pieces. If an item advertised as original is sold by Arthur Deruelle and is later suspected to be a reproduction, we will require a detailed written explanation of the issues leading to the buyer's reasoning. Arthur Deruelle will have all authenticity claims vetted by third party experts. If we are in agreement that the item purchased is not authentic to the specified time period, the buyer will be given a full refund (including shipping fees and taxes)
 
The Arthur Deruelle Lifetime Authenticity Guarantee policy is not transferable and only covers the named buyer who purchased the collectible.
 
The Arthur Deruelle Lifetime Authenticity Guarantee policy will last the lifetime of the person that purchased the collectible.
 
The Arthur Deruelle Lifetime Authenticity Guarantee is a policy, not a Certificate of Authenticity. Therefore, no paperwork will be provided.
 
 
TAXES & CUSTOMS DUTIES
Any order placed on the site and to be delivered outside the EEC may be subject to taxes and customs duties which are levied when the package reaches its destination. The taxes and custom duties relating to the delivery of the item are the responsibility of the customer.
 
 
COPYRIGHT
Arthur Deruelle is the owner of the Website's domain name.
 
The entirety of the Website, as well as its components (in particular text, structure, software, animated items, photographs, videos, illustrations, drawings, graphic representations, logos, etc.) are creative works protected by articles L. 111-1 et seq. of the French Intellectual Property Code. They are the sole property of Arthur Deruelle, and Arthur Deruelle is the sole person authorised to use said intellectual property and related personality rights, brands, trademarks, models, creative works, software, databases, interpretations and image rights, whether through ownership or through a formal authorisation or license. 
 
Use of all or part of the Website, particularly by means of downloading, reproduction, transmission, representation or circulation, for purposes other than personal and private use with a non-commercial aim, by the Internet user is strictly prohibited.
 
The creation of any hypertext link redirecting towards any one of the web pages or components of the Website without prior written authorisation from Arthur Deruelle is prohibited. Said authorisation may be withdrawn at any moment. Any such website containing hypertext links redirecting towards the Website or any one of its components are not under the control of Arthur Deruelle. Arthur Deruelle may therefore not be held liable (particularly with regard to editorial content) in relation to the access to such websites or their contents.
